Privacy Policy

This Privacy Policy explains what information My Forever Near collects, why, and what choices you have. My Forever Near is operated by Pinka Whale Studio LLC ("we", "us"). We know the photos you share are personal, often about someone you miss, and we treat them that way.

1. Information we collect

  • Photos you upload, and the videos we create from them.
  • Order details: the email address you enter at checkout, what you bought, and the date.
  • Payment information: handled by Stripe. We do not receive or store your full card number.
  • Results of our photo check: for example how many faces appear, whether the image is clear, its size and orientation. See "Faces in photos" below.
  • Technical information: IP address, browser and device type, pages visited, error reports and security logs.
  • Cookies and similar technology: we use what the site needs to work, and analytics tools that help us understand how the site is used. We do not use advertising cookies. We do not track you across other websites, so we do not respond to browser "Do Not Track" signals.
  • Messages you send us, such as support emails.

2. How we use it

  • To create your video and deliver it to you.
  • To take payment, send receipts, and give support.
  • To check that photos and videos follow our Terms, and to prevent fraud and abuse.
  • To keep the Service secure and working, and to fix problems.
  • To meet legal duties.

We do not sell your personal information. We do not use your photos to show advertising. We do not use your photos to train our own AI models.

3. Faces in photos

Many photos show faces. Our automated photo check counts faces and notes their position so that your photo suits the template you chose. We do not use facial recognition to identify anyone, and we do not store face templates or face measurements. Our AI providers analyze the faces in your photo only to create your video.

4. Who we share it with

We share information only with companies that help us run the Service, and only as needed:

  • Cloud hosting, database and file storage providers, to store your photos, videos and order records.
  • AI processing providers, to check your photo and create the video. They receive your photo to do that work. According to our AI infrastructure provider, your photos are not used to train AI models, and the model partner that creates the video must delete your photo within 24 hours.
  • Our payment processor, Stripe, to take payment and prevent fraud.
  • Video processing providers, to add a watermark to previews and to prepare the final video.
  • Analytics and email providers, to understand how the site is used and to send receipts and messages.
  • Authorities or others, when the law requires it, or to protect people's safety and our rights.
  • A buyer of our business, if we are sold, merged or reorganized, subject to this policy.

5. How long we keep it

  • Uploaded photos: deleted 30 days after your video is delivered (7 days if you do not buy), or sooner if you ask.
  • Videos: available to download for 30 days after purchase, then deleted.
  • Videos you do not purchase: deleted 7 days after they are created.
  • Order and payment records: kept as long as tax and accounting laws require, generally up to 7 years.
  • Security and error logs: kept for about 90 days.

We may keep information longer if needed to resolve a dispute, enforce our Terms, investigate abuse, or follow the law. Instead of keeping your photos and videos, we keep records of your order, the date you accepted our Terms, your confirmations about the photo, and any complaints or removal requests.

6. Your choices and rights

You can ask us to access, correct or delete your information, including your photos and videos, by emailing support@myforevernear.com. We may need to confirm it is you. We will reply within 30 days. If you are a California resident, you may also have rights to know what we collect, to delete it, to correct it, and to not be treated unfairly for using these rights. If you believe a photo was uploaded without the right to use it, contact us and we will review it.

7. Children

The Service is for adults. You must be 18 or older. We do not accept photos of people under 18 at this time. We do not knowingly collect personal information from children. If you think a child has given us information, or a photo of a minor was uploaded, contact us and we will delete it.

8. Security

We use reasonable safeguards, including private storage, access controls and encrypted connections. Your videos can be viewed only through private links that expire after a short time. No system is perfectly secure, so we cannot promise absolute security.

9. Where information is processed

We are based in the United States. Our providers may process information in the United States and other countries.

10. Changes to this policy

We may update this policy. The date at the top shows the latest version. For material changes we will post a notice on the site.
